All employees have legally binding contracts

What does this mean?

  • Both permanent and seasonal employees need to have written contracts that include all legal requirements as per the BCEA and Sectoral Determination 14.
  • It is important to understand that the contract needs to clearly define the relationship and expectations of both parties

What do I do?

The Department of Labour has an example of a contract detailing the minimum requirements, available in the Template Portal.

You can also go to the MyWage website for more information on contracts, labour legislation and employment in general:

If you are really unsure how to draw up a contract, it is a good idea to contact a lawyer or labour consultancy for advice.
