All employees must receive at least two weeks of paid annual leave per year, or more if provided for by national law or industry standards

What does this mean?

  • In South Africa, SD 14 stipulates that an employee must actually be granted at least 3 weeks (21 consecutive days) annual leave on full pay in respect of every 12 month’s worked.  This would typically be 15 work days and 6 weekend days.
  • There are other leave stipulations in the SD 14 in terms of payment of leave, in which periods leave may be taken and notice of leave amongst others which need to be looked at.
  • It is important to differentiate between annual leave and an employees’ ‘day off’ which falls under rest period.
