All employees receive a minimum of 36 consecutive hours rest per week

What does this mean?

  • The 36 hours of rest must include a Sunday, unless otherwise agreed between employer and employee in writing.
  • The rest period can be changed to at least 60 consecutive hours every two weeks, if agreed in writing
  • An employee’s weekly rest period can also be reduced by up to eight hours in any week if the rest period in the following week is extended equivalently.  For such an exception, a request needs to be made for a Ministerial Determination.
