Employees are free to join a union or any other form of worker representation such as a worker's committee

What does this mean?

  • This is known as Freedom of Association, in other words employees are free to have a form of worker representation to protect and voice their rights and concerns in the workplace.
  • Employers can also not discriminate against any employee for exercising this right.

What do I do?

The International Labour Organization has a number of Conventions on various labour issues.  Read more about Freedom of Association here: http://www.ilo.org/global/topics/freedom-of-association-and-the-right-to-collective-bargaining/lang--en/index.htm

  • Your business needs to have a Freedom of Association policy, a template of which is available.
  • The business needs to communicate this policy to all employees so that they are aware of their rights.
  • Besides having the written policy, this right should also be seen in practice.
