What does this mean?

  • To legally do business in SA you need to register your business with the Companies and Intellectual Property Commission (CIPC). Also if there is any change in the legal status of your business, you will need to change this to reflect on the register. There are many types of legal registration options available such as:
    • Private Company (Pty Ltd)
    • Close Corporation (CC)
    • Trust
  • The type of registration you choose will depend on the nature of your company, ownership in your company or type of legal setup you prefer.
  • A Private Company or a Close Corporation are preferred since they have the advantage of limiting personal liability in the event that the business fails – i.e. the business owner cannot be held liable, unlike in the instance of the business being a sole proprietor for example.
