The business recognises the right to freedom of association of the 3rd party supplier

What does this mean?

  • This means that 3rd party suppliers have the right to align themselves with or work with any other suppliers of their choosing, which may be economically beneficial to them.
  • The written contracts between the parties cannot stipulate any provisions in terms of this.
  • The business may also not discriminate against 3rd party suppliers for exercising this right.

What do I do?

  • It is a good idea to include a 3rd party supplier’s right to freedom of association in their contract.
  • The business needs to also inform their 3rd party suppliers what their right to freedom of association means.
